Privacy Policy

Your privacy and the security of your personal information are very important to Company. This Privacy Policy describes how Company collects, stores, processes and uses your information when you access or use the Service. This Privacy Policy is governed by Company’s Terms of Service located at https://switchvpn.net/terms-of-service. All capitalized terms not defined herein are defined in the Terms of Service.

Company may amend this Privacy Policy from time to time. Company will post any changes to this Privacy Policy here, therefore, please refer back to this Privacy Policy on a regular basis. By using the Service, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and you hereby consent that Company will collect, store, use, and disclose your Personally Identifiable Information in the following ways. If you do not agree with any practices in this Privacy Policy, please do not access or use the Service.

"Personally Identifiable Information" means any information that identifies you or can be used to identify or contact you.

"Non-Personally Identifiable Information" information that by itself cannot be used to identify or contact you (for example, age, profession, gender, user IP addresses, browser types, domain names, and other anonymous statistical data involving the use of the Services).

  • For sign-up: email address;
  • For credit/debit card payments: billing address and credit/debit card number (Company collects, but does not store this information on its servers; the information is stored by a payment processor);
  • For PayPal payments: PayPal email address to process the order and transaction ID associated with that order;
  • For BitPay payments: Company only requires email address used during sign-up, no additional information is collected;
  • For Live Chat support: email address;
  • For Google Analytics: anonymous Non-Personally Identifiable Information such as pages visited, geographical location of a user, conversion metrics, page loading times, and duration of web sessions related to order processing and not to VPN sessions; and
  • Web server log (Nginx).

Company does not collect or log any traffic or use of its Virtual Private Network ("VPN") service or Proxy.

Generally, Company collects, stores, processes and uses information about you to enable Company to (i) improve your experience when you use the Services, (ii) create your account, (iii) identify you as a user, (iv) respond to your inquiries and emails, and (v) send you administrative and service related communications. Except as set out in this Privacy Policy, your information will not be used for any other purpose without informing you first by updating this Privacy Policy.

Company will only disclose Personally Identifiable Information only to those officers, directors, employees, agents or contractors that have a legitimate need to know such information. In such cases, those officers, directors, employees, agents or contractors to whom such information is disclosed will have signed a non-disclosure agreement with Company prohibiting any unauthorized disclosure.

Except for the limited disclosures described in this Privacy Policy, Company does not sell customer lists or user’s usage patterns. Company will endeavor to keep your Personally Identifiable Information private.

Service Providers. Company may engage certain trusted third parties to perform functions and provide services to Company, including, without limitation, payment processing, hosting and, and database storage. Company may share your Personally Identifiable Information with these third parties, but only to the extent necessary to perform these functions and get such services.

Disclosures for Legal Purposes. Company may disclose your Personally Identifiable Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend Company’s rights or property, (iii) act in urgent circumstances to protect the personal safety of Service users or the public, or (iv) protect Company from legal liability.

The security of your information is important to Company. Company takes commercially reasonable technical and organizational security measures against loss or unauthorized processing of Personally Identifiable Information, including without limitation, the use of encryption, firewalls, Secure Sockets Layer and Payment Card Industry Data Security Standard protocols. Additionally, Company implements general industry security standards as well as physical safeguards of the locations where such information is stored.

You are also responsible for helping Company protect the security of your Personally Identifiable Information. For instance, never give out your password, and remember to log out of your account when you are finished using the Service. Despite these measures, you should know that Company cannot fully eliminate security risks associated with your information.

Pursuant to Section 1798.83 of the California Civil Code, residents of California may obtain certain information about the types of personal information that companies with whom they have an established business relationship have shared with third parties during the preceding calendar year. The law provides that companies must inform consumers about the categories of personal information that have been shared with third parties, the names and addresses of those third parties and examples of the types of services or products marketed by those third parties. As part of the functionality of the Service, you may be able access or use Third-Party Services. The security and safety of any Personally Identifiable Information or other data you transmit to Third-Party Services is beyond Company’s control or responsibility. Company cannot and will not be responsible for security of any Personally Identifiable Information or other data you transmit to any Third-Party Service. Third-Party Services have their own privacy polices, security measures and procedures and Company assumes no liability to investigate, assess, approve or monitor such policies. Company strongly recommends that you review the respective Third-Party Service’s privacy policy so you can understand the method and manner in which information about you will be collected, stored, processed and used when transmitted to or processed by any Third-Party Service.

Like many other Internet services, the Service may use cookies. A cookie is a small amount of information stored locally on your computer or device that enables the Service to recall certain data or settings. Company uses cookies to enable tracking and analysis of usage patterns, sections and sites visited prior to, during and after accessing the Service. If you do not wish to have cookies stored on your computer or device, you should immediately change your settings to disable or refuse the use of cookies before using the Service. If you disable or refuse the use of cookies, certain features of the Service may not function properly, fully or as advertised.

The Service is not available for access or use by individuals under 18 years of age. Company does not knowingly collect any information from anyone under 18 years of age. In the event that Company learns that it has collected Personally Identifiable Information from an individual under the age of 18 without any prior parental consent, Company will delete that information as quickly as possible. By accessing and using the Service, you represent and warrant that you are at least 18 years of age.
